Advances in DNA technology and the discovery of DNA polymorphisms have permitted the creation of DNA databases of individuals for the purpose of criminal investigation.Many ethical and legal problems arise in the preparation of a DNA database, and these problems are especially important when one analyses the legal regulations on the subject.In this paper three main groups of possibilities, three systems, are analysed in relation to databases. The first system is based on a general analysis of the population; the second (...) one is based on the taking of samples for a particular list of crimes, and a third is based only on the specific analysis of each case. The advantages and disadvantages of each system are compared and controversial issues are then examined. We found the second system to be the best choice for Spain and other European countries with a similar tradition when we weighed the rights of an individual against the public's interest in the prosecution of a crime. Localization Wireless Sensor Networks (WSN) represent a research topic with increasing interest due to their numerous applications. However, the viability of these systems is compromised by the attained localization uncertainties once implemented, since the network performance is highly dependent on the sensors location. The Node Location Problem (NLP) aims to obtain the optimal distribution of sensors for a particular environment, a problem already categorized as NP-Hard. Furthermore, localization WSN usually perform a sensor selection for determining which nodes are to be (...) utilized for maximizing the achieved accuracy. This problem, defined as the Sensor Selection Problem (SSP), has also been categorized as NP-Hard. While different metaheuristics have been proposed for attaining a near optimal solution in both problems, no approach has considered the two problems simultaneously, thus resulting in suboptimal solutions since the SSP is biased by the actual node distribution once deployed. In this paper, a combined approach of both problems simultaneously is proposed, thus considering the SSP within the NLP. Furthermore, a novel metaheuristic combining the Black Widow Optimization (BWO) algorithm and the Variable Neighbourhood Descent Chains (VND-Chains) local search, denominated as BWO-VND-Chains, is particularly devised for the first time in the author’s best knowledge for the NLP, resulting in a more efficient and robust optimization technique. Finally, a comparison of different metaheuristic algorithms is proposed over an actual urban scenario, considering different sensor selection criteria in order to attain the best methodology and selection technique. Results show that the newly devised algorithm with the SSP criteria optimization achieves mean localization uncertainties up to 19.66 % lower than traditional methodologies. (shrink)

Today, in both theory and practice, the concepts of corporate social responsibility and ethics are not necessarily related. Organizations can demonstrate high levels of social proactivity in their CSR policies with or without having laudable levels of ethical quality or virtuousness. This article introduces the concepts of organizational ethical quality to evaluate the moral excellence of CSR actions and policies, identifying and categorizing varying levels ranging from the absence of ethical virtuousness, termed immoral CSR, to high levels of moral CSR, (...) or ethical virtuousness. High MCSR is the product of both high levels of OEQ in conjunction with more proactive CSR policies based on social action. (shrink)

Previous research has suggested that in cultural production fields the concatenation of eminence explains success, defined as influence and innovation. We propose that individuals in fields as diverse as philosophy, literature, mathematics, painting, or architecture gain visibility by cumulating the eminence of others connected to them across and within generations. We draw on interaction ritual chain and social movement theories, and use evidence from the field of modernist architecture, to formulate a model of how networks of very strong ties generate (...) motivations and emotional enthusiasm, change reputations, and form collective movements that over time transform the structure of cultural fields. Because major aesthetic innovations break sharply with older styles, they need very strong group solidarity over a long period of time to propagate a new standard of practice. We propose mutual halo effects, i.e., the reciprocal reinforcement of upstream and downstream prestige on a given individual node, as the key factor accounting for success in a cultural production field. We discuss the relevance of these results for building a model of influence and innovation in cultural production fields in which networks—reshaped by shifting technological, political, and economic conditions—trigger new styles. En estas páginas se reúnen tres trabajos elaborados en diferentes fechas, pero estrechamente interrelacionados bajo la intención global de aportar algunos elementos a la evaluación de las opciones metodológicas y epistemológicas en el campo de la investigación en Ciencias Sociales. Esos tres escritos nacen de la preocupación por los riesgos a que se ven expuestos los procesos de producción de conocimientos en el área social, sobre todo si consideramos que, dadas ciertas circunstancias del debate epistemológico actual, casi a diario aparecen (...) ofertas bajo la con?signa del nuevo paradigma o del paradigma emergente. Ante estas ofertas suele ocurrir que unos se muestran entusiasmados y otros incrédulos, pero muy pocos, relativamente, se dedican a evaluarlas. Así, sin evaluar las distintas opciones, la investigación social podría llegar a extremos de li?bertinaje académico, inoperancia y descrédito, incumpliendo de ese modo con el delicado compromiso que tienen los investigadores -tesistas, tuto?res y profesores- con respecto a las necesidades de la sociedad actual. En general, el supuesto inicial más importante aquí es que no pode?mos asumir ciegamente una determinada oferta metodológica y epistemo?lógica, por atractiva que parezca, si previamente no la sometemos a una crítica dura, desinteresada y honesta. Bajo esos términos, tomando en cuenta el predominio y la creciente influencia que han llegado a ejercer las propuestas del «paradigma emergente» sobre noveles investigadores sin que éstos dispongan de un cuerpo amplio de contrargumentaciones y señalamientos divergentes, los trabajos aquí presentados se orientan a deslindar aspectos que parecen significativos para una crítica severa y puntual. Esto es aun más urgente si consideramos que, apartando el caso de muchos investigadores respetables y serios que trabajan bajo la óptica del paradigma emergente, recientemente han pululado las posiciones anárqui?cas y descabelladas que también se declaran bajo esa misma óptica. Y, según parece, es aquí donde late un importante peligro para la investiga?ción social. Esperamos que de los trabajos aquí recogidos puedan también deducirse esas diferencias. (shrink)

El problema de la enajenación del ser humano es una constante en la obra teórica y narrativa de José Revueltas. El hecho de que el tema carcelario aparezca con frecuencia en sus relatos y novelas, en algunos de los cuales la cárcel deviene un personaje más, obedece precisamente a su interés en dicho problema. Como aquí se muestra, Revueltas no sólo buscaba exponer y analizar la enajenación humana, sino a la vez explorar posibles vías de liberación. De ahí que, mientras (...) que en sus primeros trabajos se centró en el sistema penitenciario, gradualmente pasó a abordar en ellos el encierro en el espacio público y en la propia conciencia. The dissemination and reception of Bernard Bolzano's ideas were not only mediated by his personal circumstances and context but also by the vicissitudes of his work. This paper traces the fate of his works from his death in 1848 to the publication of the first volume of his Gesamtausgabe in 1969, and it does so with the help of one of the last published volumes of this edition, namely the Bolzano‐Gesamtbibliographie 1804–1999. As the paper shows, this book is more than (...) a mere list of publications and constitutes a highly valuable resource for anyone interested in Bolzano studies, the use of which is explained in detail. El Misterio de la Trinidad constituye el centro de la fe cristiana. Para la teología es también la verdad fundamental, que ilumina las demás realidades creídas. Esta situación indica que ha quedado atrás el “esplendido aislamiento” de la doctrina trinitaria que denunciaban los grandes teólogos del siglo XX. El presente trabajo pretende mostrar los logros de esta renovación trinitaria de la teología, especialmente en los ámbitos de la antropología teológica, la teología de la familia, la eclesiología y la doctrina social (...) de la Iglesia. Junto con los frutos maduros de esta nueva dimensión trinitaria de la teología, no se ocultan sus límites y riesgos. Creemos que esta nueva proposición trinitaria de las verdades cristianas puede ser válida en nuestro contexto postmoderno y postsecular. (shrink)

On September 19th, 2005, an Spanish blogger wrote a post against blog nets. In that post he showed a kierkegaardian interpretation of blogging issue. It was the first time someone was using strictly philosophical categories in the blogosphere. On 2006, February, the 23rd, Rafael Herrera Guillén made a philosophical dramatization about this issue in a game of heteronyms.

This article explores the metaphor of Science as provider of sharp images of our environment, using the epistemological framework of Objective Cognitive Constructivism. These sharp images are conveyed by precise scientific hypotheses that, in turn, are encoded by mathematical equations. Furthermore, this article describes how such knowledge is pro-duced by a cyclic and recursive development, perfection and reinforcement process, leading to the emergence of eigen-solutions characterized by the four essential properties of precision, stability, separability and composability. Finally, this article discusses (...) the role played by ontology and metaphysics in the scientific production process, and in which sense the resulting knowledge can be considered objective. The full Bayesian signi/cance test (FBST) for precise hypotheses is presented, with some illustrative applications. In the FBST we compute the evidence against the precise hypothesis. We discuss some of the theoretical properties of the FBST, and provide an invariant formulation for coordinate transformations, provided a reference density has been established. This evidence is the probability of the highest relative surprise set, “tangential” to the sub-manifold (of the parameter space) that defines the null hypothesis.

Numerous researchers have examined the antecedents of trust between managers and subordinates. Recent studies conclude that their influence varies depending on whether what is being examined is a manager's trust in a subordinate or a subordinate's trust in a manager. However, the reasons given to justify this phenomenon present limitations. This article offers a new theoretical approach that relates the influence of each antecedent to Aristotelian forms of reasoning, ethical, and instrumental. The proposed approach shows that the influence of each (...) antecedent depends on which rationality prevails in the person who trusts. The contribution of this article is to better explain the phenomenon of interpersonal trust formation and its logic, while offering at the same time several practical implications for managers interested in developing an organizational culture based on trust. The article begins with a literature review of more relevant empirical studies analyzing superior–subordinate trust formation and presents some theoretical limitations of the arguments described in these works. Then, it offers a new theorerical approach based on Aristotelian thought to explain the influence of the antecedents of trust in management–subordinate relationships. The theoretical contribution is then confirmed in an empirical study of 163 mid-level managers in Spain. (shrink)

Sortition, i.e. random appointment for public duty, has been employed by societies throughout the years as a firewall designated to prevent illegitimate interference between parties in a legal case and agents of the legal system. In judicial systems of modern western countries, random procedures are mainly employed to select the jury, the court and/or the judge in charge of judging a legal case. Therefore, these random procedures play an important role in the course of a case, and should comply with (...) some principles, such as transparency and complete auditability. Nevertheless, these principles are neglected by random procedures in some judicial systems, which are performed in secrecy and are not auditable by the involved parties. The assignment of cases in the Brazilian Supreme Court is an example of such a procedure, for it is performed using procedures unknown to the parties involved in the judicial cases. This article presents a review of how sortition has been historically employed by societies and discusses how Mathematical Statistics may be applied to random procedures of the judicial system, as it has been applied for almost a century on clinical trials, for example. A statistical model for assessing randomness in case assignment is proposed and applied to the Brazilian Supreme Court. As final remarks, guidelines for the development of good randomization procedures are outlined. (shrink)

Recognizing that the presence of the Religious School Teaching discipline in public elementary schools in Brazil is a complex and controversial subject, it is of fundamental importance that alternatives be sought so that its offer takes place in such a way as to enable the emergence of conscious and participatory people in the process of transforming society. It was in pursuit of this objective that the authors of this article found in the category of conscientização, proposed by Paulo Freire, a (...) possible way for teachers of the Religious Education discipline of Brazilian public schools to contribute to the formation of autonomous citizens, with a critical conscience, capable of making their own choices, with full freedom. Methodologically, the article was organized using the See, Judge and Act method. This method of analysis allows us to look at the socioeconomic, political and cultural reality in which people are inserted, to confront a specific theoretical instrument, with the aim of proposing possible ways and alternatives for the promotion of a liberating education. Thus, in the first section analyzes two theoretical categories related to education, namely: banking education and liberating education. In the second section, an attempt was made to weave an approach around the category of conscientização, proposed by Paulo Freire. In the third section, the authors present possible paths of action for a liberating education based on the teaching of Religious Education. (shrink)

Este estudio da cinco pasos. En el primero se caracterizan los orígenes del análisis reflexivo. Bajo el título “origen” se incluyen, principalmente, las motivaciones y el campo de aplicación al cual está referido. En el segundo paso, se presentan las características del análisis reflexivo, sobre todo en términos de supuestos y de la relación del mismo con el canon fenomenológico de estirpe husserliana. En el tercer paso, se valora el alcance del análisis reflexivo como técnica; en cierto modo, se estudia (...) cómo puede operar con y sin la fenomenología como enfoque, teoría o método integral dentro de la investigación. En el cuarto paso, se establece cómo el análisis reflexivo ha encontrado unas alternativas de aplicación, por parte de Lester Embree; sobre todo, se mira el enlace que tiene o puede tener con la individuación al tenor de la lectura de Ideas II de Husserl. Como cierre, en el quinto paso, se establece críticamente el alcance del análisis reflexivo y las posibilidades que ofrece para el desarrollo o continuación de la fenomenología, en el contexto de las vertientes contemporáneas sobre este enfoque.The article is divided into five moments. The first one presents the origins of the reflective analysis; under the title “origin” is included, mainly, the motivations and the scope to which it is referred. The second one refers to the characteristics of the reflective analysis, especially in terms of assumptions and relate to the same lineage husserlian’s phenomenological canon. The third one assesses the scope of the reflective analysis as technique; in this way, it explores how can operate with and without the Phenomenology as approach, theory or method integral within the research. The fourth one sets how reflective analysis has found some alternatives of the application by Lester Embree; most of all, the link that has or can have is regarded with to the individuation in way of Ideas II by Husserl. Finally, it sets critically the scope of the reflective analysis and the possibilities for devel-opment or continuation of Phenomenology in the context of the contemporary approach in this perspective. El artículo reconoce los aportes que la Dra. Julia V. Iribarne realizó en torno a la ética en perspectiva fenomenológica, especialmente en su obra De la ética a la metafísica. Con base en estas contribuciones se responden tres preguntas: ¿cómo la generatividad y la temporalidad se convierten en estructuras de la eticidad? ¿Cómo hay, fenomenológicamente, una metafísica en cuanto se conoce la mismidad y la alteridad trascendentalmente? ¿Es Dios para la ética un fictum o un factum? A modo de colofón (...) se alude a la centralidad de la mente y el esclarecimiento de los estados mentales como avance en el fundamento y despliegue de la ética.This article identify the contributions that Dra. Julia V. Iribarne made around ethics in phenomenological perspective and especially her work Ethics in the way of metaphysics. According to her contributions we could answer these three questions: How generativity and temporality becomes structures of the ethics? How is possible, phenomenologically, a metaphysics if we know self-hood and otherness transcendentally? Is God a fictum or factum for the ethics? As a final reference, we will talk about the centrality of mind and we will try to clarify the rationale and mental states like a development of the ethics. (shrink)

Resumen Tanto la migración como el exilio, al lado del extranjero y el extraño, han sido objeto de la investigación fenomenológica. En este estudio se da un pequeño paso con respecto a la fenomenología de la migración. En particular, se lleva a cabo una profundización en torno a un estrato fundante: el éxodo en sus intrincadas relaciones con estratos tales como la frontera y la diáspora. Así, centramos la atención en el éxodo como experiencia y en los estratos protofundadores de (...) la comprensión de la migración. Con esta mirada, se dan tres pasos, a saber, se caracteriza la relación existente entre 1. El éxodo y la constitución trascendental; se establece la interrelación entre 2. La frontera y la comunidad de pertenencia; y, finalmente, se mira cómo 3. La diáspora opera la constitución trascendental de la esperanza. A manera de 4. Conclusiones se vuelve la atención a la constitución trascendental como fundamento de la ética.Migration like exile, alongside the stranger and the stranger, have been the subject of phenomenological research. In this study a small step is taken regarding the phenomenology of migration. In particular, a deepening is carried out around a founding stratum: the exodus in its intricate relation- ships with strata such as the border and the diaspora. Thus, we focus attention on the exodus as experience and on the foundational layers of the understanding of migration. With this view, three steps are taken, namely, the relationship between the exodus and the transcendental constitution is characterized; the interrelation is established between 2. The border and the community of belonging; and, finally, we look at how 3. The diaspora operates the transcendental constitution of hope. By way of 4. Resumen La educación superior se ha constituido en un objeto de creciente interés en la literatura especializada. A pesar de lo anterior, la mayor parte de la investigación disponible se concentra en estudios de corte descriptivo y evaluativo, sin conectar sus desarrollos con las reflexiones de la teoría sociológica. El presente ensayo identifica las principales posibilidades teóricas y epistemológicas de la teoría de sistemas sociales para el análisis de la educación superior, examinando los rendimientos de la noción de diferenciación de (...) planos de formación sistémica (interacción, organización y sociedad) y la idea de diferenciación de sistemas parciales especializados. Abstract Higher education has become an object of growing interest in the specialized literature. Despite this, most of the available research concentrates on descriptive and evaluative studies, without connecting its developments with the reflections of general sociological theory. This essay identifies the main theoretical and epistemological possibilities of social systems theory for the analysis of higher education, examining the uses of the notion of differentiation of systemic formation planes (interaction, organization, and society) and the idea of differentiation of specialized partial systems. This article has as its theme the democracy as fundamentalism, or the democratic fundamentalism. Its main objective is the recognition that the thinking about democracy can itself be fundamentalist, implying that not only religious fundamentalisms are a threat to contemporary democracy. Its method and object are the interpretation of texts by two contemporary philosophers who do not usually talk to each other, the Italian Gianni Vattimo and the French Jean-Luc Nancy. The essay's thesis is the affirmation of democratic thinking as (...) a form of fundamentalism, insofar as it fulfills certain conditions established by the two thinkers analyzed. These conditions are, in the language of the aforementioned philosophers, the framing of democracy under the so-called strong thought, or its subsumption to a metaphysical way of thought, so that it becomes incapable of self-criticism and its necessary reinvention. Thus, it is expected to contribute to the construction of a self-critical vision of democracy through dialogue with aspects of thought little known of important philosophers and also through the dialogue between philosophy and theology as emancipatory ways of knowing. This article provides a critical reading of the ‘Parecer CNE-CES 60, de 2014’, from the Ministry of education, Brazil, which defines the curriculum guidelines for courses of Baccalaureate in Theology. In its first section it discusses the theoretical background of the ‘Parecer’, questioning its illuminist orientation, as well as its pedagogical theory focused on contents and not on the students activities. It aims to show that are two opposed educational paradigms in the ‘Parecer’, the illuminist and the constructivist, although the (...) illuminist is the dominant one. It also question the view of the theologian present in the ‘Parecer’, marked by significant absences from the professional field of religious work. In the second section, the article presents a sample of particular interpretation of the ‘Parecer’, indicating the guidelines of a curriculum based on the constructivist paradigm. It dedicates special attention to the occult dimension of the curriculum and to an articulation of the student’s activities in relationship to the disciplines of the course. (shrink)

El déjà vu es problemático en el fin de siglo (XIX), no por la ensoñación poética que trae consigo, sino por la perturbación que le causa a la vida. De allí la preocupación de los “savants” por entenderlo, controlarlo y “curarlo”. El déjà vu irrumpe en la vida cotidiana del sujeto, lo perturba, lo desconcierta. De allí que Bodei lo relacione con el eterno retorno de Nietzsche. Más que un caso aislado o “patológico” ligado a individuos “pa(de)cientes” como los epilépticos, (...) o una “válvula de escape de la realidad”, el déjà vu sería para Bodei, la irrupción (la erupción) de una ilusión frente a la realidad “operante”. El déjà vu pone en crisis la supuesta identidad “absoluta” del sujeto, su dimensión del tiempo y su “confianza” en la continuidad de la personalidad. Para hablar de él es necesario, como sugiere Bodei, referirse al tema del “doble” en la literatura del siglo XIX. (Dostoievski más que Stevenson). (shrink)

El objetivo de este estudio es analizar las investigaciones de pregrado en Literatura de una universidad peruana. Se realizó el mapeo sistemático de diez trabajos publicados entre el 2017 y 2022. Los resultados evidencian preferencia por la investigación en literatura peruana y que el género literario más estudiado es el narrativo. Se concluye que en los trabajos no se describen claramente los métodos científicos ni las metodologías de análisis literario; debido a su diversidad, a que los estudios literarios poseen una (...) complejidad interdisciplinaria, y porque los esfuerzos educativos universitarios en investigación se centran en los últimos semestres. This article considers distinct ways of understanding the world, referred to in psychology as Functions of Consciousness or as Cognitive Modes, having as the scope of interest epistemology and natural sciences. Inspired by C.G. Jung's Simile of the Spectrum, we consider three basic cognitive modes associated to: (R) embodied instinct, experience, and action; (G) reality perception and learning; and (B) concept abstraction, rational thinking, and language. RGB stand for the primary colors: red, green, and blue. Accordingly, a conceptual map between (...) cognitive modes and primary and secondary colors is built based on the physics and physiology of color perception and epistemological characteristics of the aforementioned cognitive modes, leading to logical relations structured as an Hexagon of Opposition. Finally, this model of cognitive modes is applied to the analysis and interpretation of some important episodes in the historical development of physics and technology. (shrink)
